A real estate agent has what is known as a fiduciary duty to their client. That is, they have the responsibility to act in the best interests of their client.   A car salesman does not have to act in your best interests -- they just have to sell the car., however, real estate agents must act under legislated laws in offering their services.

The selling of a home entails a lot of liability, which is the reason why there is a mountain of paperwork involved in disclosure statements and contracts. Your agent wants to make sure everything is covered. Hiring a knowledgeable seller’s agent to navigate through the voluminous amounts of required paperwork would be worth the investment alone in the headaches it saves you and the possibility of making a costly mistake should you go it alone.

Fortunately though, the real estate agent will not only demystify all the legal-ese and confusing terminology used in the real estate industry on disclosure statements and contracts. They will also help you with all the aspects of selling your home.

Before you even get down to listing your home for sale, your seller’s agent should provide you with a comprehensive marketing proposal and comparative market analysis report. The marketing proposal should explain in detail what it is that your agent will be doing to bring about the successful sale of your property. The marketing analysis report shows the recent sales of similar properties in your area.

It is appropriate for the seller to request to see samples of advertisements used for other listings from this real estate agent. Inquire about what types of fliers or brochures will be used in the advertising of your listing. Will there be ‘open houses’ or ‘appointment only’ showings? How often will these occur? What inspections are needed before the house can be shown to buyers? Your agent must disclose material facts about your home such as plumbing, foundation, or roof problems to buyers, therefore it is wise to fix these problems before listing your home if possible, or consider that pre-existing problems may reduce the value of your property to buyers.
